The Department has referred your letter to the GSC and can advise the GSC has provided advice as follows: It is noted the Planning proposal intends to rezone the land from IN1 General Industrial to B2 Business zone which will allow retail and business purposes. The correspondence indicates that Inner West Council has advised a preference for the planning proposal to add the additional uses to the zone applying to the land rather than rezone the property. This will be a matter for the Department to determine in consultation with Council and any planning proposal should be considered as part of the current LEP Review and Local Strategic Planning Statement (LSPS) process. It is noted the Department’s Assessment team is also currently assessing a modification application which relates to the land at 13-55 Edinburgh Rd, Marrickville. The land is zoned IN1-General Industrial under Marrickville LEP 2011 and that the Part 3A Approval was granted for development of the land for retail and business purposes in March 2012 with subsequent modifications approved. It understood that Stage 1A of the approval has physically commenced. It is considered that whilst the provisions of the District Plan still continue to apply in respect of the Industrial zoned land, the effect and activation of the Part 3A approval prior to the adoption of the District Plan means that the retain and manage policy in the Plan is not to be enforced for this land and the Department may consider a planning proposal to rezone the land to permit retail and business purposes (as well as the Modification application) on its merits and relevant legislation.
